1. Acceptance of Terms

By accessing or using Review Web ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you may not use the Service.

Review Web is operated by Mixture Web LLC ("Review Web," "we," "us," or "our").

2. Description of the Service

Review Web is a reputation management platform that allows businesses and agencies to:

  • Send review requests via email and SMS
  • Generate review links and QR codes
  • Create and distribute customer surveys
  • Display review directory pages
  • Track review activity and analytics
  • Compare review performance against competitors
  • Use AI-assisted tools for review text improvement and response suggestions

Review Web does not post reviews on behalf of users and does not guarantee review outcomes.

3. Eligibility

You must be at least 18 years old and authorized to act on behalf of a business to use Review Web. Agencies must have authorization from their clients to manage accounts on their behalf.

4. User Responsibilities

4.1 Lawful Use

You agree to use Review Web only for lawful purposes and in compliance with all applicable laws, regulations, and platform policies.

4.2 Consent for Messaging

By using Review Web's email and SMS features, you represent and warrant that:

  • You have obtained proper consent from recipients
  • Messages are related to an existing business relationship
  • You are not using purchased, scraped, or rented contact lists

Review Web is not responsible for consent violations by users.

5. SMS Messaging Terms (10DLC Compliance)

5.1 Message Purpose

Messages sent through Review Web are limited to:

  • Review requests
  • Review follow-ups
  • Survey invitations
  • Transaction-related communications

Prohibited uses include:

  • Cold outreach
  • Lead generation spam
  • Promotions unrelated to a transaction
  • High-risk content prohibited by carriers

5.2 Opt-Out

Recipients may opt out at any time by replying STOP. Users must not attempt to override or ignore opt-outs.

5.3 Message Delivery

Message frequency may vary. Carriers are not liable for delayed or undelivered messages.

6. AI Features Usage

Review Web provides optional AI-assisted tools.

You acknowledge and agree:

  • AI suggestions are advisory only
  • Users retain full control over submitted content
  • Review Web does not fabricate reviews or experiences
  • AI will not be used to gate or suppress negative reviews
  • You are responsible for reviewing and approving all AI-assisted content before submission

7. Third-Party Platform Compliance

7.1 General Requirements

Users must comply with the terms and guidelines of third-party review platforms and data providers, including but not limited to:

  • Google
  • Zillow
  • Yelp
  • Facebook
  • TripAdvisor
  • Industry-specific platforms

7.2 Google Places API

Review Web uses the Google Places API to retrieve and display business information, ratings, and reviews. By using Review Web, you acknowledge and agree to comply with:

  • Google Maps Platform Terms of Service: https://cloud.google.com/maps-platform/terms
  • Google's Privacy Policy: https://policies.google.com/privacy

Restrictions on Google Data:

  • You may not copy, store, or cache Google reviews or business data beyond what is necessary for display
  • Google reviews must be displayed with author attribution
  • You may not use Google data to create competing products or services
  • You may not scrape, bulk download, or systematically extract Google data
  • Google data must be displayed with appropriate attribution

7.3 Zillow

For real estate professionals using Zillow integration, you agree to comply with:

  • Zillow Terms of Use: https://www.zillowgroup.com/terms-of-use/
  • Zillow API Terms of Use: https://www.zillowgroup.com/developers/terms/

Restrictions on Zillow Data:

  • Zillow branding and attribution requirements must be followed
  • You may not store, cache, or redistribute Zillow data
  • Zillow data may only be used for personal, non-commercial purposes unless otherwise permitted
  • Links back to Zillow must be maintained as required

7.4 Review Integrity

Review Web does not:

  • Incentivize reviews (offering payment, discounts, or rewards for reviews)
  • Filter reviews by sentiment (hiding negative reviews)
  • Manipulate platform review systems
  • Create fake or misleading reviews

Users must not use Review Web to violate any review platform's policies regarding authentic reviews.

8. Survey Feature Terms

Review Web provides survey creation and distribution tools for paid plan users.

  • Surveys are created and controlled by the business
  • Businesses are responsible for the content of their survey questions
  • Survey responses are stored securely and owned by the business
  • Review Web does not share survey responses with third parties except as required for service operation

9. Accounts, Plans, and Billing

9.1 Subscriptions

Some features require a paid subscription. Billing is handled via Stripe.

9.2 Downgrades & Non-Payment

If payment fails:

  • Paid features are disabled
  • The account reverts to the Free plan
  • Paid data may be retained for up to 90 days

After 90 days, paid-only features and data may be permanently removed.

9.3 Agency Accounts

Agencies are responsible for:

  • Billing of their managed clients
  • Compliance of client messaging
  • Managing plan selection per client
  • Ensuring clients comply with all platform terms

Clients managed by agencies are not billed directly by Review Web.

10. Data Ownership and Usage

10.1 Your Data

Businesses retain ownership of their own data (customer lists, survey responses, custom content). ReviewWeb is granted a limited license to process data solely to provide the Service.

10.2 Third-Party Data

Data obtained from third-party services (Google, Zillow, etc.) remains the property of those services and their licensors. You may not:

  • Claim ownership of third-party data
  • Redistribute third-party data outside of Review Web
  • Use third-party data for purposes not permitted by their terms

10.3 Aggregated Data

Review Web may anonymize and aggregate data for analytics and platform improvement.

11. Intellectual Property

11.1 Review Web Content

The Review Web platform, including its design, code, logos, and documentation, is the property of Mixture Web LLC and is protected by intellectual property laws.

11.2 Third-Party Trademarks

Google, Google Maps, and related marks are trademarks of Google LLC. Zillow and related marks are trademarks of Zillow Group. All other trademarks are the property of their respective owners. Use of these marks on Review Web is for identification purposes only and does not imply endorsement.

12. Termination

We may suspend or terminate access if:

  • These Terms are violated
  • Messaging abuse is detected
  • Carrier or provider requirements are breached
  • Third-party API terms are violated
  • Illegal or prohibited activity occurs

Users may cancel subscriptions at any time via their account dashboard.

13. Disclaimers

ReviewWeb is provided "as is" without warranties of any kind. We do not guarantee:

  • A specific number of reviews
  • Review sentiment
  • Search ranking improvements
  • Business outcomes
  • Availability or accuracy of third-party data

Third-party data (including Google and Zillow data) is provided "as is" by those services. ReviewWeb is not responsible for the accuracy, completeness, or availability of third-party data.

14. Limitation of Liability

To the fullest extent permitted by law, ReviewWeb shall not be liable for indirect, incidental, consequential, or punitive damages arising from use of the Service, including but not limited to:

  • Loss of data
  • Business interruption
  • Inaccurate third-party data
  • Delayed or undelivered messages
  • Changes to third-party API availability

15. Indemnification

You agree to indemnify and hold harmless ReviewWeb and MixtureWeb LLC from any claims arising from:

  • Your use of the Service
  • Messaging consent violations
  • Platform policy violations
  • Third-party terms violations
  • Third-party disputes

16. Changes to Terms

We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance.

17. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles.
